The rules of the road

These Terms of Service (“Terms”) govern your access to and use of HiSalon, a salon management platform operated by Join Future Solutions W.L.L., a company registered in the Kingdom of Bahrain (“HiSalon”, “we”, “us”). By accessing or using HiSalon you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
HiSalon provides software-as-a-service tools that help salons, spas, barbershops, and nail studios manage bookings, staff, inventory, loyalty programs, payments, and customer communications. The Services include the HiSalon dashboard for salon operators, the booking sites used by end customers, and related applications and APIs.
2. Accounts & eligibility
To use most features you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You must be at least 18 years old, or of legal age to enter into a binding contract in your jurisdiction. You are responsible for all activity under your account.
3. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law.
- Send unsolicited bulk messages, spam, or content that violates the WhatsApp Business Policy or any other carrier policy.
- Impersonate any person or business, or misrepresent your affiliation with any party.
- Attempt to access, probe, or test the vulnerability of the Services without our prior written consent.
- Interfere with the integrity, security, or performance of the Services or any data they contain.
- Reverse-engineer, decompile, or attempt to extract the source code of the Services, except to the extent permitted by law.
- Resell, sublicense, or otherwise commercialise the Services without our written agreement.
4. Salon-operator obligations
If you use HiSalon to operate a salon, you additionally agree:
- You are the data controller for your own customer records and are solely responsible for the lawfulness, accuracy, and any required consents for the data you upload to or generate within HiSalon.
- You will provide your end customers with a privacy notice that describes how their data will be processed by you and by HiSalon as your processor.
- You will comply with all applicable consumer-protection, e-commerce, and data-protection laws in the markets in which you operate.
- You will only send messages to customers who have given the appropriate level of consent under WhatsApp’s policies and applicable law.
5. Fees & billing
Some features are offered on a paid subscription. Fees, billing cycles, and applicable taxes will be presented to you before purchase and may change with prior notice. Unless required by law, fees are non-refundable. We may suspend or terminate access for non-payment.
6. WhatsApp Business integration
HiSalon is a WhatsApp Business Solution Provider (Tech Provider) that integrates with Meta’s WhatsApp Business Platform on behalf of salon operators. By connecting your WhatsApp Business account to HiSalon you authorise us, as your Tech Provider, to send and receive messages through Meta’s API on your behalf, and you agree to be bound by Meta’s applicable terms, including the WhatsApp Business Terms of Service, the WhatsApp Business Policy, and the WhatsApp Business Solution Terms. Violations of those policies may result in suspension of your WhatsApp Business account by Meta independently of any action by HiSalon.
7. Intellectual property
The Services, including all software, designs, logos, and content we provide, are owned by Join Future Solutions W.L.L. or our licensors and are protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose. You retain all rights to the data and content you upload to HiSalon, and grant us a limited licence to host, process, and display it solely to operate the Services for you.
8. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
9. Limitation of liability
To the maximum extent permitted by law, neither HiSalon nor Join Future Solutions W.L.L. nor our affiliates, directors, employees, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or your use of the Services. Our total aggregate liability for direct damages will not exceed the amount you paid to us for the Services in the twelve months preceding the event giving rise to the claim, or USD 100, whichever is greater.
10. Indemnification
You agree to defend, indemnify, and hold harmless HiSalon and Join Future Solutions W.L.L. from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) the data or content you upload; or (d) your violation of any third- party right, including intellectual-property and privacy rights.
11. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any breach of these Terms or if we reasonably believe such action is necessary to protect the Services or other users. You may terminate your account at any time by following the in-app process or by contacting us. Sections that by their nature should survive termination (intellectual property, disclaimers, liability, indemnity, governing law) will survive.
12. Governing law & disputes
These Terms are governed by the laws of the Kingdom of Bahrain, without regard to its conflict-of-laws principles. Disputes arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain, except where applicable consumer-protection law gives you the right to bring proceedings in the courts of your place of residence.
13. Changes
We may revise these Terms from time to time. The most current version will always be posted at this URL with the “Last updated” date. Material changes will be announced through the Services or by email at least 14 days before they take effect. Your continued use of the Services after the effective date of a change constitutes acceptance.
